Terms of Service — BZZR

Article 1 — Purpose and nature of the service

1.1 Editorial positioning

BZZR is an editorial application for NBA news and statistical analysis, published by SCALE ME UP. BZZR is not a sports betting operator. SCALE ME UP does not take any wagers, does not organize any gambling, does not hold any funds on behalf of its users, and does not recommend betting.

The application offers:

  • NBA scores presented spoiler-free (adjustable blur mechanism);
  • AI-generated post-game analyses, for informational and editorial purposes;
  • an Insights tab composed of editorial statistical reads (matchups, x-factor, team signals, what to watch for), for informational purposes only;
  • a "Decode my ticket" feature allowing the user to submit a screenshot to receive an editorial statistical reading of the combination it represents.

1.2 No financial or betting advice

The statistical content published by BZZR does not constitute financial advice, investment advice, or sports betting advice. No observed correlation, no statistical trend, no editorial verdict should be interpreted as an invitation or incitement to bet, wager, or commit funds.

The user remains solely responsible for the use they make of the information consulted and for any financial decision they may take elsewhere.

1.3 No display of market odds

BZZR does not display any market odds, lines, spreads, totals, or other sports betting market parameters on the surface of the application. The Insights tab only exposes editorial statistical indicators (pace, offensive and defensive efficiency, offensive rebound rate, etc.).

Article 2 — Acceptance of the Terms

Access to and use of the application implies unreserved acceptance of these Terms. If you do not agree with all or part of these Terms, you are invited not to use the application.

Article 3 — Access conditions

3.1 Minimum age

The application is intended for an adult audience (18+). The Insights tab features a permanent "+18 — editorial statistical analysis" banner displayed at the bottom of the screen. No betting content, no market odds, no lines are present on the surface of the application.

3.2 User account

Registration requires a valid email address and a password. The user agrees to provide accurate information and to keep their credentials confidential.

The publisher reserves the right to suspend or delete an account in case of abusive use (spam, fraud, circumvention, etc.) without compensation.

Article 4 — Premium subscription

4.1 Terms

BZZR offers a Premium subscription at the rate of:

  • €3.99 per month (automatic monthly renewal);
  • €29.99 per year (automatic annual renewal) — i.e. 33% off compared to monthly.

The Premium subscription unlocks notably:

  • full access to detailed Insights reads;
  • removal of advertising;
  • enriched access to the analyses archive.

4.2 Payment

Payment is processed exclusively by Apple (App Store) or Google (Google Play). No banking details are transmitted to Morning Hoop SASU. BZZR uses RevenueCat to synchronize subscription status.

4.3 Renewal and cancellation

The subscription automatically renews at each due date, unless cancelled at least 24 hours before the end of the current period. Cancellation is performed from:

  • iOS: Settings → Apple ID → Subscriptions
  • Android: Google Play → Account → Payments and subscriptions → Subscriptions

4.4 Right of withdrawal (EU)

In accordance with Article L.221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content supplied without a tangible medium whose execution has begun with your express consent. By activating the Premium service, you expressly waive your right of withdrawal.

4.5 Apple Family Sharing

The Premium subscription is shareable via Family Sharing on iOS, within the limits defined by Apple's rules.

Article 5 — Editorial disclaimer

The content published by BZZR is editorial and statistical journalism. The analyses produced — including those generated by artificial intelligence (Anthropic's Claude) — are provided "as-is" without warranty of accuracy.

The user acknowledges that:

  • statistics may contain errors or lags;
  • AI analyses reflect observed trends, never certainties;
  • Insights reads are informational editorial content and do not predict in any way the outcome of a game;
  • the user is solely responsible for any financial decision made elsewhere on the basis of this information.

SCALE ME UP cannot in any case be held responsible for financial losses related to sports bets placed by the user with third parties.

Article 6 — Intellectual property

All elements of the application (text, graphics, logos, produced analyses, structure) are protected by copyright and, where applicable, by neighboring rights. The user has a personal, non-exclusive, and non-transferable right to use the application within the framework of these Terms.

NBA team names, logos, and statistical data relating to the NBA belong to their respective holders (NBA Properties Inc., its franchises, and their data partners). SCALE ME UP uses these elements in an editorial context protected by the right to inform.

Article 7 — User behavior

The user shall refrain in particular from:

  • circumventing the technical mechanisms of the application (blur, paywall, +18 banner);
  • using automated means (bots, scrapers) to extract content;
  • republishing or redistributing the analyses without written authorization;
  • submitting images containing illegal, shocking, or contrary to morality content via the "Decode my ticket" feature;
  • impersonating others;
  • harming the service or its security.

Article 8 — Personal data

The processing of personal data is governed by our Privacy Policy, accessible at: https://bzzr-nba-legal.vercel.app/privacy

The user has the rights provided by the GDPR (access, rectification, erasure, portability, objection, restriction).

Account deletion can be performed directly from the application (Profile → Account → Delete my account).

Article 9 — Limitation of liability

The publisher commits to making its best efforts to ensure the availability and quality of the service, without being able to guarantee uninterrupted or error-free availability.

The publisher cannot be held responsible for:

  • financial losses linked to betting, wagering, or investment decisions made by the user based on the content consulted;
  • unavailability related to maintenance, hosting infrastructure, or third-party services (Apple, Google, Supabase, Anthropic, etc.);
  • indirect, immaterial, or unforeseeable damages.

Article 10 — Changes to the Terms

The publisher reserves the right to modify these Terms at any time. Substantial modifications will be notified to the user via a banner in the application and/or by email. Continued use after notification constitutes acceptance of the new Terms.

Article 11 — Applicable law and disputes

11.1 Applicable law

These Terms are governed by French law.

11.2 Consumer mediation

In accordance with Article L.612-1 of the French Consumer Code, the consumer user residing in France can use the following mediation service free of charge:

ℹ️ For the CMAP mention to be enforceable, SCALE ME UP must have previously signed an adhesion agreement with the CMAP. Failing that, the mention must be removed or replaced by another approved mediator.

The user may also use the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr/

11.3 Competent jurisdiction

In the absence of an amicable resolution, the dispute will be brought before the competent courts in accordance with common law rules.
